Warranty and Replacement

This Warranty and Replacement Policy explains the warranty protection, repair, replacement, and other remedies applicable to products purchased through bricolonex.com (the “Website”).

The Website is operated by Weprod S.R.L. (“Company”, “we”, “us”, or “our”).

This Policy should be read together with our:

  • Terms and Conditions

  • Refund Policy

  • Shipping Policy

  • Right of Withdrawal Policy

  • Product Complaints and Disputes Policy

  • Privacy Policy

Nothing in this Policy limits, excludes, or replaces mandatory rights granted to Consumers under applicable Italian or European Union consumer protection law.

1. Seller Information

The seller is:

Weprod S.R.L.

80146 Naples (NA), Italy

VAT Number: IT10883491218

2. Legal Guarantee of Conformity

Products sold to Consumers through the Website are covered by the statutory legal guarantee of conformity provided by applicable consumer protection law.

For new goods, the legal guarantee generally covers qualifying lack of conformity that becomes apparent within two years from delivery.

The legal guarantee cannot be excluded or reduced to the detriment of the Consumer.

3. Who Is Considered a Consumer?

For the purposes of this Policy, a Consumer is generally a natural person purchasing products for purposes outside their commercial, entrepreneurial, craft, or professional activity.

Different warranty rules may apply to purchases made primarily for business or professional purposes.

4. Seller Responsibility

For the statutory legal guarantee, the Consumer should contact the seller from whom the product was purchased.

For products purchased through bricolonex.com, warranty requests may therefore be submitted directly to:

info@bricolonex.com

The existence of a manufacturer’s warranty does not remove the Consumer’s statutory rights against the seller.

5. What Is a Lack of Conformity?

A product may be considered non-conforming where, depending on the circumstances, it:

  • Does not correspond to its description

  • Does not have the agreed characteristics

  • Does not have the agreed quantity or quality

  • Is unsuitable for its normal intended purpose

  • Is unsuitable for a particular purpose agreed with the seller

  • Does not include required accessories

  • Does not include necessary instructions

  • Does not provide the functionality reasonably expected

  • Does not correspond to samples or models shown before purchase

  • Does not possess the durability reasonably expected for goods of the same type

  • Presents another qualifying lack of conformity under applicable law

The existence of a lack of conformity is assessed according to the product, contract, product description, reasonable expectations, and applicable law.

6. Duration of the Legal Guarantee

For new goods sold to Consumers, the statutory legal guarantee generally lasts two years from the date of delivery.

The guarantee concerns qualifying defects of conformity existing at the time of delivery, including defects that become apparent during the applicable guarantee period.

7. Time for Enforcing Warranty Rights

Under the applicable Italian Consumer Code rules, the seller is generally responsible for qualifying lack of conformity appearing within two years from delivery.

The action to enforce remedies for defects not fraudulently concealed by the seller is generally subject to the applicable statutory limitation period.

Consumers are encouraged to report problems as soon as reasonably possible after discovering them.

8. Proof of Purchase

When submitting a warranty request, customers should provide proof that the product was purchased through bricolonex.com.

Useful evidence may include:

  • Order confirmation

  • Order number

  • Invoice

  • Payment confirmation

  • Transaction record

  • Other documentation demonstrating the purchase

We may be able to identify an order directly through our records when sufficient customer information is available.

9. Warranty Request

To submit a warranty request, please contact:

info@bricolonex.com

Where possible, include:

  • Full name

  • Order number

  • Product name

  • Product code or model

  • Date of purchase

  • Date of delivery

  • Description of the problem

  • Photographs where relevant

  • Video where useful to demonstrate the issue

  • Serial number where applicable

Providing complete information may allow us to assess the request more efficiently.

10. Initial Assessment

After receiving a warranty request, we may review:

  • Order information

  • Product information

  • Description of the problem

  • Photographs

  • Videos

  • Serial numbers

  • Installation information

  • Usage information

  • Manufacturer documentation

We may request reasonable additional information where necessary to determine the nature of the reported problem.

11. Product Inspection

In some cases, the product may need to be physically inspected.

We may provide instructions for:

  • Returning the product

  • Delivering it to an authorized service location

  • Packaging the product

  • Providing accessories

  • Providing documentation

  • Identifying the warranty request

Customers should not automatically send products to our registered office unless specifically instructed to do so.

The appropriate return or service location may be different from the Company’s registered address.

12. Primary Warranty Remedies

Where a qualifying lack of conformity is established, Consumers are generally entitled in the first instance to have the product brought into conformity through:

  • Repair, or

  • Replacement

subject to the conditions established by applicable law.

13. Consumer Choice Between Repair and Replacement

Where legally applicable, the Consumer may request repair or replacement.

However, the requested remedy may not be available where it is:

  • Objectively impossible; or

  • Disproportionately costly compared with the alternative remedy,

taking into account the circumstances required by applicable law.

14. Repair

Where repair is the appropriate remedy, we may arrange for the defective product to be repaired.

The repair procedure may involve:

  • Technical inspection

  • Diagnostic testing

  • Replacement of defective components

  • Restoration of product functionality

  • Software or firmware intervention where relevant

  • Other appropriate corrective work

15. Repair Without Charge

Where repair is due under the statutory legal guarantee, it will be carried out without cost to the Consumer, as required by applicable law.

This may include costs that the seller is legally required to bear in connection with restoring conformity.

16. Repair Time

Warranty repairs must be completed within an appropriate period considering circumstances such as:

  • Nature of the product

  • Nature of the defect

  • Product complexity

  • Availability of parts

  • Intended use of the product

The repair must not cause significant inconvenience to the Consumer beyond what is reasonably necessary.

17. Replacement

Where replacement is the appropriate remedy, the defective product may be replaced with a conforming product.

The replacement may depend on:

  • Product availability

  • Product model

  • Product specifications

  • Inventory

  • Whether replacement is legally appropriate and proportionate

18. Replacement Product

Where the same product is available, we will normally seek to provide the same model or equivalent conforming product.

If the identical product is no longer available, we may discuss an appropriate solution with the customer in accordance with applicable law.

This may include an equivalent product or another legally available remedy.

19. Replacement Without Charge

Where replacement is required under the statutory legal guarantee, the replacement will be provided without costs that applicable law requires the seller to bear.

The Consumer will not be charged simply for exercising a valid statutory warranty right.

20. Availability of Replacement Products

A particular replacement may become unavailable because of circumstances such as:

  • Product discontinuation

  • Manufacturer changes

  • Lack of stock

  • Model replacement

  • Supply chain changes

Where replacement is impossible or not legally appropriate, another remedy available under consumer law may apply.

21. Removal and Reinstallation

Where a product was installed in a manner consistent with its nature and intended purpose before the lack of conformity became apparent, statutory rules concerning removal and installation costs will apply where relevant.

Each case will be assessed according to the nature of the product and applicable law.

22. When Repair or Replacement Is Not Possible

There may be circumstances where neither repair nor replacement is a practicable remedy.

This may occur, for example, where:

  • Repair is impossible

  • Replacement is impossible

  • Both remedies would impose disproportionate costs

  • The seller has not restored conformity within an appropriate period

  • The defect remains despite attempts to restore conformity

  • The defect is sufficiently serious to justify another remedy

  • Repair or replacement would cause significant inconvenience to the Consumer

In such circumstances, other statutory remedies may become available.

23. Price Reduction

Where the conditions established by applicable law are satisfied, the Consumer may be entitled to an appropriate reduction of the purchase price.

The reduction should be proportionate to the decreased value of the product resulting from the lack of conformity.

24. Termination of the Contract

Where the applicable statutory requirements are met, a Consumer may have the right to terminate the sales contract in relation to a non-conforming product.

Termination may result in return of the affected product and reimbursement in accordance with applicable law.

25. Minor Defects

Where a lack of conformity is only minor, termination of the entire sales contract may not be available where applicable law provides otherwise.

Other remedies, such as repair, replacement, or an appropriate price reduction, may still apply.

26. Refunds Under Warranty

A warranty refund is different from a refund resulting from the 14-day right of withdrawal.

Warranty refunds concern products affected by a qualifying lack of conformity.

Where termination and reimbursement are legally appropriate, refunds will be processed according to applicable consumer law and our Refund Policy.

27. Legal Guarantee vs Right of Withdrawal

The legal guarantee and the right of withdrawal are separate rights.

The right of withdrawal generally allows an eligible Consumer to change their mind about an online purchase within the statutory period.

The legal guarantee protects the Consumer where a product has a qualifying lack of conformity.

A customer does not need to rely on the ordinary right of withdrawal when they are exercising statutory rights concerning a defective product.

28. Legal Guarantee vs Commercial Warranty

A statutory legal guarantee must not be confused with a voluntary commercial or manufacturer warranty.

A commercial warranty may provide additional benefits such as:

  • Longer coverage

  • Additional repair services

  • Manufacturer assistance

  • Specific replacement conditions

  • Additional technical support

Any commercial warranty is additional to, and does not replace or reduce, the statutory legal guarantee.

29. Manufacturer Warranty

Certain products may be covered by an additional warranty provided by their manufacturer.

The conditions of such warranty may vary according to:

  • Manufacturer

  • Product

  • Product category

  • Country

  • Warranty duration

  • Warranty terms

Where a manufacturer warranty exists, relevant documentation may be included with the product or made available by the manufacturer.

30. Contacting the Manufacturer

In some cases, contacting the manufacturer or an authorized technical service provider may provide a faster technical solution.

However, where statutory seller liability applies, directing the customer to a manufacturer does not eliminate mandatory rights that the Consumer may exercise against us as the seller.

31. Products With Digital Elements

Certain physical products may include or depend on:

  • Software

  • Firmware

  • Applications

  • Digital services

  • Connected functionality

Where applicable, statutory conformity requirements relating to goods with digital elements also apply.

This may include obligations concerning functionality and necessary updates where required under applicable law.

32. Software and Firmware Updates

For products requiring software or firmware to remain conforming, relevant updates may be provided by the manufacturer or service provider.

Customers should install security, functionality, or conformity-related updates where reasonably necessary and follow applicable instructions.

Failure to install an update after being appropriately informed may affect the assessment of a subsequent issue where applicable law provides so.

33. Installation Problems

Where a lack of conformity results from incorrect installation for which the seller is legally responsible, the problem may fall within statutory conformity protection.

This may include circumstances where:

  • Installation formed part of the sales contract and was performed incorrectly by or under the responsibility of the seller; or

  • Incorrect installation resulted from deficient installation instructions supplied with the product, where applicable.

34. Customer Installation

Where the customer installs a product independently, the customer should follow:

  • Manufacturer instructions

  • Product documentation

  • Safety instructions

  • Technical specifications

  • Applicable installation requirements

Damage caused solely by incorrect installation unrelated to a defect in the product or instructions may not constitute a lack of conformity.

35. Professional Installation

Some products may reasonably require installation by appropriately competent or qualified professionals.

Where relevant, we may request reasonable information concerning installation when investigating a warranty claim.

This may include:

  • Installation date

  • Installer information

  • Installation photographs

  • Technical configuration

  • Connections

  • Relevant measurements

Such requests will only be made where reasonably relevant to the alleged defect.

36. Improper Use

The statutory legal guarantee does not generally cover damage caused solely after delivery by inappropriate use unrelated to an original lack of conformity.

Examples may include:

  • Deliberate damage

  • Accidental impact

  • Use contrary to instructions

  • Use outside specified operating conditions

  • Unauthorized modification

  • Incorrect maintenance

  • Improper storage

Each warranty request will be evaluated individually.

37. Normal Wear and Tear

Normal deterioration resulting solely from ordinary use over time is not automatically a lack of conformity.

The assessment may take into account:

  • Nature of the product

  • Expected durability

  • Frequency of use

  • Age of the product

  • Maintenance

  • Product specifications

Normal wear should not be confused with premature failure caused by a qualifying defect.

38. Consumable Parts

Certain components may naturally be subject to consumption or wear.

Depending on the product, these may include components whose expected life is influenced by frequency and conditions of use.

A consumable component may still be covered where the issue results from a qualifying lack of conformity rather than normal consumption or wear.

39. External Damage

Damage arising solely from external causes occurring after delivery may not qualify as a lack of conformity.

Examples may include:

  • Impact

  • Water exposure contrary to specifications

  • Fire

  • Electrical damage caused by unsuitable external systems

  • Extreme environmental conditions outside product specifications

  • Unauthorized alterations

This does not affect claims where the product itself failed to provide characteristics or protection that it was contractually required to provide.

40. Maintenance Requirements

Where a product requires maintenance, the customer should follow the instructions provided with the product.

A warranty assessment may consider whether required maintenance was performed where this is materially relevant to the reported fault.

We will not deny a valid statutory warranty claim merely because of irrelevant or unnecessary formalities.

41. Unauthorized Repairs or Modifications

Unauthorized repairs or modifications may complicate the assessment of a warranty request.

A statutory claim will not automatically be rejected solely because a product has been opened or examined.

However, damage directly caused by an unauthorized intervention may not constitute a defect for which the seller is responsible.

42. Serial Numbers and Product Identification

For certain warranty requests, we may ask for:

  • Serial number

  • Model number

  • Product code

  • Batch number

  • Manufacturing information

This information may be necessary to identify the product, determine specifications, check applicable manufacturer information, or investigate known technical issues.

43. Evidence of the Defect

Depending on the nature of the issue, we may request reasonable evidence such as:

  • Photographs

  • Videos

  • Error messages

  • Diagnostic information

  • Description of circumstances in which the fault occurs

Providing such information can sometimes allow us to resolve the issue without requiring the product to be returned immediately.

44. Burden of Proof

Applicable consumer law determines who must establish whether a lack of conformity existed at the time of delivery.

Under the current Italian Consumer Code framework, a lack of conformity that becomes apparent within one year from delivery is generally presumed to have existed at delivery unless this presumption is incompatible with the nature of the goods or the defect.

For defects becoming apparent later, different evidentiary rules may apply.

45. Warranty Shipping

Where a product must be sent back in connection with a valid statutory warranty claim, the applicable legal rules concerning the costs necessary to restore conformity will apply.

Consumers will not be charged costs that the seller is legally required to bear.

46. Packaging for Warranty Returns

Products returned for inspection, repair, or replacement should be packaged appropriately to prevent additional transportation damage.

Where reasonably possible, please include:

  • Product

  • Relevant accessories

  • Components necessary to reproduce the fault

  • Documentation requested by us

Original retail packaging is useful where available but will not be imposed as an unlawful condition for exercising statutory warranty rights.

47. Products Damaged During Return

Customers should follow the return and packaging instructions provided to minimize transportation risks.

Responsibility for loss or damage occurring during warranty-related transport will be determined according to the applicable circumstances and law.

48. Replacement of Individual Components

Where appropriate, conformity may be restored by replacing only the defective component rather than the entire product.

Whether component-level repair is appropriate depends on:

  • Product design

  • Nature of the defect

  • Technical feasibility

  • Applicable legal requirements

49. Repeated Defects

If a product continues to present a lack of conformity after an attempted repair or other remedy, the Consumer may have additional remedies available under applicable law.

The appropriate solution will depend on the circumstances of the case.

50. Product No Longer Manufactured

If a defective product is no longer manufactured or available, we may determine an appropriate alternative in accordance with applicable law.

Depending on the circumstances, this may include:

  • Repair

  • Equivalent replacement

  • Price reduction

  • Contract termination and reimbursement

51. Equivalent Replacement

Where an identical replacement cannot reasonably be supplied and an equivalent product is proposed, relevant factors may include:

  • Product functionality

  • Technical specifications

  • Quality

  • Intended use

  • Value

Any solution must respect the Consumer’s applicable statutory rights.

52. Warranty and Promotional Products

Products purchased during:

  • Sales

  • Discounts

  • Promotions

  • Coupon campaigns

  • Special offers

remain covered by applicable statutory conformity rights.

A discounted purchase price does not by itself reduce the legal guarantee.

53. Clearance Products

Products sold as clearance or discounted stock remain subject to statutory conformity requirements.

However, a Consumer generally cannot claim a lack of conformity based solely on a specific defect that was clearly disclosed and expressly accepted before purchase where applicable law permits such treatment.

Other undisclosed qualifying defects remain subject to applicable rights.

54. Business Customers

The statutory Consumer guarantee described in this Policy is intended for Consumers.

Purchases made primarily for:

  • Business

  • Professional

  • Commercial

  • Entrepreneurial

  • Craft

purposes may instead be governed by applicable contractual and civil-law warranty provisions.

Any commercial warranty specifically offered for business purchases will be subject to its stated terms.

55. Product Safety Issues

If you believe a product presents a potential safety hazard, stop using the product where appropriate and contact us promptly:

info@bricolonex.com

Please provide:

  • Order number

  • Product identification

  • Description of the safety concern

  • Photographs or videos where relevant

Safety reports may be treated with priority depending on their nature.

56. Recalls

Where a product sold through the Website becomes subject to a recall or other safety corrective action, we may take appropriate measures in accordance with applicable requirements.

These may include:

  • Contacting customers

  • Providing safety instructions

  • Requesting that use of the product cease

  • Arranging return

  • Repairing or replacing affected goods

  • Providing another appropriate remedy

57. Fraudulent Warranty Claims

We reserve the right to investigate requests that reasonably appear fraudulent or abusive.

This may include situations involving:

  • Substitution of a different product

  • Manipulation of serial numbers

  • Deliberate product damage

  • Falsified purchase information

  • Altered documentation

  • Repeated fraudulent claims

This provision will not be used to restrict legitimate statutory warranty rights.

58. Warranty Records

We may retain information relating to warranty requests where necessary for purposes including:

  • Customer service

  • Repair administration

  • Replacement management

  • Fraud prevention

  • Product quality monitoring

  • Accounting

  • Legal compliance

  • Establishing or defending legal claims

Personal data will be processed according to our Privacy Policy.

59. Relationship With Refund Policy

Our Refund Policy contains additional information regarding:

  • Refund processing

  • Return procedures

  • Damaged products

  • Incorrect products

  • Payment reimbursement

Where a refund results from a statutory warranty remedy, mandatory consumer protection law will prevail over any inconsistent commercial policy.

60. Relationship With Right of Withdrawal

The 14-day Right of Withdrawal applies to eligible distance purchases where a Consumer simply changes their mind.

The Legal Guarantee of Conformity concerns products that are defective or otherwise do not conform to the sales contract.

The expiry of the ordinary withdrawal period does not eliminate warranty rights that remain applicable.

61. Mandatory Consumer Rights

Nothing in this Warranty and Replacement Policy is intended to:

  • Exclude the statutory legal guarantee

  • Shorten mandatory guarantee periods

  • Impose unlawful warranty costs

  • Force Consumers to use a manufacturer’s warranty instead of statutory rights

  • Remove legally available repair or replacement rights

  • Prevent access to other statutory remedies

Where this Policy conflicts with a mandatory provision of applicable consumer law, the mandatory provision will prevail.

62. Changes to This Policy

We may update this Warranty and Replacement Policy to reflect changes in:

  • Applicable legislation

  • Warranty procedures

  • Product categories

  • Technical support arrangements

  • Logistics

  • Manufacturer services

  • Business operations

The latest version will be published on this page.

Updates will not remove mandatory rights applicable to purchases already made.
