Refund Policy

This Refund Policy explains the conditions applicable to returns, withdrawals, refunds, damaged products, incorrect products, and defective or non-conforming goods purchased through bricolonex.com (the “Website”).

The Website is operated by Weprod S.R.L. (“Company”, “we”, “us”, or “our”).

This Policy should be read together with our Terms and Conditions, Privacy Policy, and any specific information displayed during checkout.

Nothing in this Refund Policy limits or excludes any mandatory rights granted to consumers under applicable Italian or European Union consumer protection law.

1. Seller Information

The seller is:

Weprod S.R.L.

80146 Naples (NA), Italy

VAT Number: IT10883491218

Email: info@bricolonex.com
Website: bricolonex.com

For return, refund, withdrawal, damaged product, or warranty requests, please contact:

info@bricolonex.com

2. Consumer Right of Withdrawal

If you are purchasing as a Consumer, you generally have the right to withdraw from an online purchase without providing a reason within 14 days.

For purchases of goods, the withdrawal period generally begins on the day on which you, or a third party designated by you other than the carrier, physically receive the goods.

If a single order contains multiple products delivered separately, the withdrawal period generally begins from receipt of the last product where applicable under consumer law.

Certain statutory exceptions may apply, as explained below.

3. How to Request a Return

To exercise your right of withdrawal, you must inform us of your decision before the withdrawal period expires.

Please contact:

info@bricolonex.com

Your request should preferably include:

  • Full name

  • Order number

  • Email address used for the order

  • Product or products you wish to return

  • Date the order was received

  • A clear statement that you wish to withdraw from the purchase

You do not need to provide a reason for exercising the statutory right of withdrawal.

We may provide return instructions and the appropriate return destination after receiving your request.

4. Return Authorization

We recommend contacting us before returning a product so that we can provide the correct return instructions and identify the returned order efficiently.

Failure to request a return authorization does not remove a Consumer’s statutory right of withdrawal when that right has been exercised correctly within the applicable legal period.

5. Deadline for Returning Products

After communicating your decision to withdraw, products must be returned within the period required by applicable consumer law.

For statutory withdrawals, this is generally within 14 days from the date on which you communicated your decision to withdraw.

Products should be sent using the return instructions provided by us.

6. Condition of Returned Products

Consumers are permitted to inspect and handle a product to the extent reasonably necessary to establish its:

  • Nature

  • Characteristics

  • Functioning

You may be responsible for any diminished value of the goods resulting from handling beyond what is reasonably necessary for this purpose.

Products should therefore be returned, where reasonably possible, with:

  • All components

  • Accessories

  • Manuals

  • Documentation

  • Parts supplied with the product

Original packaging should also be returned where reasonably possible, particularly where it helps protect the product during transportation.

Opening the original packaging does not automatically remove a Consumer’s statutory right of withdrawal, except where a specific legal exception applies.

7. Return Packaging

Customers should package returned products appropriately to protect them during transportation.

Where possible, use:

  • The original protective packaging

  • Suitable external packaging

  • Appropriate cushioning material

  • All original components and accessories

Products should not be shipped without sufficient protection.

8. Return Shipping Costs

For a standard return resulting solely from a Consumer changing their mind and exercising the statutory right of withdrawal, the direct cost of returning the goods is borne by the customer, unless we expressly state otherwise.

We may occasionally offer free returns as part of a promotion or specific commercial policy.

Any such offer will be clearly communicated separately.

9. Defective, Damaged or Incorrect Products

The rules concerning ordinary withdrawal should not be confused with situations where a product:

  • Arrives damaged

  • Is defective

  • Does not conform to the contract

  • Is materially different from the product ordered

  • Is incomplete due to an error attributable to us

In these situations, please contact us at:

info@bricolonex.com

Where the problem falls within our legal responsibility, the customer will not be required to bear costs that applicable law requires the seller to cover.

10. Refund Amount for a Withdrawal

Where a Consumer validly exercises the statutory right of withdrawal, we will refund the payments received from the Consumer in accordance with applicable law.

This generally includes:

  • The purchase price of the returned product

  • The cost of the least expensive standard delivery method offered for the original order, where reimbursement of delivery costs is legally required

11. Premium Delivery Costs

If the customer expressly selected a delivery method that was more expensive than the least expensive standard delivery method offered by us, the additional delivery cost may not be refunded.

For example, additional charges for an optional express delivery service may remain excluded from the refund where permitted by law.

12. Partial Returns

If an order contains multiple products and only some products are returned, the refund will normally relate only to the products validly returned.

Any refund of original delivery charges will be determined according to:

  • The circumstances of the order

  • Whether the delivery cost would have been incurred regardless of the returned item

  • The applicable consumer protection rules

13. Refund Processing Time

Where a statutory right of withdrawal has been validly exercised, reimbursement will be made within the period required by applicable law.

For Consumer withdrawals, this is generally no later than 14 days from the date on which we are informed of the decision to withdraw.

However, for sales of goods, we may withhold reimbursement until:

  • We have received the returned goods; or

  • You provide evidence that the goods have been sent back,

whichever occurs first, where permitted by law.

14. Refund Method

Refunds will normally be issued using the same payment method used for the original purchase, unless:

  • A different method has been expressly agreed with the customer; or

  • Technical or legal circumstances require another appropriate method

A Consumer will not be charged a fee solely because a statutory reimbursement is being made.

15. Bank and Payment Processing Times

After a refund has been issued by us, additional processing time may be required by:

  • Banks

  • Card issuers

  • Payment providers

  • Financial institutions

The time required for the amount to appear in your account may therefore depend on the payment method used.

These external processing times are outside our direct control.

16. Cancelled Orders

If an order is cancelled before shipment and payment has already been collected, the applicable amount will be refunded.

Where an order has already entered the shipping process, it may no longer be possible to stop the shipment.

In such cases, the customer may need to follow the applicable return procedure after delivery.

17. Refused Deliveries

Simply refusing a parcel at delivery is not necessarily equivalent to correctly exercising the statutory right of withdrawal.

Customers wishing to withdraw from a purchase should clearly communicate their decision to us at:

info@bricolonex.com

If a parcel is refused or returned to us without prior communication, we will review the circumstances and process the matter in accordance with applicable law.

18. Incorrect Delivery Address

Customers are responsible for providing accurate and complete shipping information when placing an order.

If an order cannot be delivered because the customer provided:

  • An incorrect address

  • An incomplete address

  • Incorrect contact information

  • Other materially incorrect delivery information

additional shipping or reshipping costs may be charged where legally permitted.

This does not apply where the delivery problem is attributable to us or our service providers.

19. Uncollected Parcels

If a parcel is made available at a collection point and is not collected within the applicable period, it may be returned to us.

Where an order is returned due to failure to collect it, we may contact the customer to determine whether:

  • The order should be resent

  • The customer wishes to exercise a valid withdrawal right

  • A refund is due

Additional delivery costs may apply where legally permitted and where the failed delivery is attributable to the customer.

20. Damaged Products

If a product arrives damaged, please contact us as soon as reasonably possible.

To allow us to assess the problem efficiently, we may request:

  • Order number

  • Description of the damage

  • Photographs of the product

  • Photographs of the external packaging

  • Photographs of the internal packaging

  • Photograph of the shipping label, where useful

Customers should retain the product and packaging until we have provided instructions where reasonably possible.

These requests are intended to help us investigate the damage and do not remove mandatory statutory rights.

21. Visible Shipping Damage

If the parcel is visibly damaged, opened, crushed, or tampered with at the time of delivery, we recommend documenting the condition immediately.

Where reasonably possible, photographs should be taken before or during opening of the parcel.

Prompt notification helps us investigate the matter with the carrier.

Failure to immediately report visible transportation damage does not eliminate rights that cannot legally be waived.

22. Incorrect Products

If you receive a product different from the product ordered, please contact:

info@bricolonex.com

Please provide:

  • Your order number

  • The product ordered

  • The product received

  • Photographs where reasonably useful

Once the error has been verified, we will provide an appropriate solution in accordance with applicable law.

23. Missing Products or Components

If an order or product arrives with missing items or components, please contact us.

We may request reasonable evidence to identify the issue.

Depending on the circumstances, the solution may include:

  • Sending the missing component

  • Replacing the affected product

  • Another appropriate remedy

  • A refund where legally applicable

24. Defective or Non-Conforming Products

Products sold to Consumers are covered by the applicable legal guarantee of conformity.

A product may be non-conforming where, for example, it:

  • Does not correspond to its description

  • Does not possess agreed characteristics

  • Is unsuitable for its normal intended purpose

  • Does not provide the functionality reasonably expected

  • Has a qualifying manufacturing defect

The precise assessment depends on the product, contract, and applicable law.

25. Legal Guarantee

For new goods sold to Consumers, the statutory legal guarantee generally covers qualifying lack of conformity that becomes apparent within the legally established period.

Under the applicable Italian consumer rules, this protection generally applies for two years from delivery for new consumer goods.

This statutory guarantee exists independently of any additional manufacturer’s warranty.

26. Remedies for Non-Conforming Products

Where a qualifying lack of conformity exists, Consumers may be entitled to the remedies provided by applicable consumer law.

Depending on the circumstances, these may include:

  • Repair

  • Replacement

  • Appropriate price reduction

  • Termination of the sales contract and reimbursement

Applicable law determines which remedy is available and in what order.

27. Repair or Replacement

Where legally applicable, repair or replacement of a non-conforming product must be provided:

  • Without cost to the Consumer

  • Within a reasonable period

  • Without significant inconvenience to the Consumer

The availability of a particular remedy may depend on whether it is possible and proportionate in the circumstances.

28. Price Reduction or Refund for Non-Conforming Goods

Where the conditions established by applicable consumer law are satisfied, a Consumer may be entitled to an appropriate reduction in price or termination of the contract with reimbursement.

This may apply, for example, in circumstances where the applicable requirements for repair or replacement cannot be satisfied.

Any statutory refund for a lack of conformity will be processed according to applicable law.

29. Manufacturer Warranty

Some products may also include a commercial or manufacturer’s warranty.

A commercial warranty is additional to the Consumer’s statutory rights.

It does not replace, reduce, or exclude the legal guarantee of conformity.

Where a manufacturer’s warranty applies, its specific conditions may be contained in the documentation accompanying the product.

30. Products Damaged by Misuse

The legal guarantee does not cover problems that are solely attributable to circumstances unrelated to a lack of conformity existing under applicable law, such as, where relevant:

  • Improper use

  • Accidental damage caused after delivery

  • Incorrect installation by the customer

  • Unauthorized modification

  • Failure to follow safety instructions

  • Improper maintenance

Each claim will be evaluated according to the circumstances and applicable law.

31. Installation-Related Products

For products that require installation, users should carefully follow:

  • Installation instructions

  • Manufacturer recommendations

  • Safety requirements

  • Technical specifications

Where professional installation is reasonably required, customers should use appropriately competent or qualified personnel.

Nothing in this section excludes liability where the installation itself forms part of our contractual obligations or where applicable consumer law provides otherwise.

32. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply in certain circumstances established by law.

Depending on the products sold through the Website, exceptions may include:

  • Goods made to the customer’s specifications

  • Clearly personalized goods

  • Goods liable to deteriorate or expire rapidly

  • Sealed goods that are not suitable for return for health protection or hygiene reasons and have been unsealed after delivery

  • Goods that, after delivery, have become inseparably mixed with other items

  • Other circumstances expressly excluded by applicable consumer legislation

An exception will only be applied where the relevant legal conditions are satisfied.

33. Customized and Made-to-Order Products

Products manufactured or modified specifically according to a customer’s individual specifications may not qualify for the statutory right of withdrawal where the legal exception for customized goods applies.

This does not affect rights relating to:

  • Defective products

  • Incorrect products

  • Lack of conformity

  • Damage for which the seller is legally responsible

34. Hygiene-Sealed Products

Where legally applicable, sealed products that are not suitable for return for genuine health protection or hygiene reasons may lose the statutory withdrawal right once their seal has been removed after delivery.

This exception will only be used where the legal requirements for the exception are satisfied.

35. Products Showing Excessive Use

The statutory withdrawal period allows Consumers to inspect goods.

However, if a returned product has been used or handled beyond what is reasonably necessary to establish its nature, characteristics, and functioning, the Consumer may be responsible for the resulting diminished value.

Any reduction will be assessed reasonably and in accordance with applicable law.

36. Products Returned Incomplete

Where a product is returned without accessories, components, manuals, or other items originally supplied with it, we may assess whether this has caused a reduction in the product’s value.

Any deduction from a statutory refund will only be applied where legally permitted and proportionate to the actual diminished value.

37. Promotional Purchases

Products purchased during:

  • Sales

  • Promotions

  • Discount campaigns

  • Coupon campaigns

remain subject to statutory Consumer rights.

A discounted price does not by itself remove the right of withdrawal or legal guarantee where those rights apply.

The amount refunded will normally be based on the amount actually paid for the returned product.

38. Discount Codes

Where a discount code was applied to an order, any refund will take into account the actual amount paid and the way in which the promotion was applied to the order.

Discount codes generally have no cash value unless expressly stated otherwise.

39. Gift Purchases

Refunds for products purchased as gifts will generally be returned through the original transaction and payment method unless otherwise agreed or required by law.

We may need information identifying the original purchase before processing the request.

40. Business Purchases

The statutory Consumer right of withdrawal described in this Policy applies to Consumers.

Purchases made by companies, professionals, or individuals acting primarily for business or professional purposes may be subject to different rules.

For business purchases, return rights may be limited to:

  • Rights expressly agreed with us

  • Applicable contractual rights

  • Rights concerning defective or non-conforming products

  • Other mandatory rights provided by law

41. Return Inspection

Returned goods may be inspected after arrival to verify:

  • Product identity

  • Condition

  • Components

  • Accessories

  • Nature of the return

  • Any claimed defect or damage

Inspection does not affect a Consumer’s statutory rights.

It helps us determine the appropriate processing of the return.

42. Fraudulent or Abusive Returns

We reserve the right to investigate suspected fraudulent activity, including:

  • Returning a different product

  • Returning counterfeit items

  • Deliberately damaging products

  • Manipulating order or return information

  • Repeated fraudulent refund claims

Where there is reasonable evidence of fraud or abuse, we may take appropriate action in accordance with applicable law.

This provision will not be used to restrict legitimate Consumer rights.

43. Refund Notification

Once a refund has been processed, we may send confirmation to the email address associated with the order.

The notification may contain:

  • Order reference

  • Refunded amount

  • Refund status

  • Relevant payment information

44. Refunds to Expired or Replaced Cards

If the original payment card has expired or been replaced, the refund will generally still be processed through the original payment transaction where supported by the payment provider.

The customer’s bank or payment provider normally redirects the refund to the appropriate account.

If this is not technically possible, we may contact the customer regarding an alternative method.

45. Chargebacks

Customers experiencing a problem with an order are encouraged to contact us first at:

info@bricolonex.com

This gives us an opportunity to investigate and resolve the matter.

Nothing in this Policy prevents a customer from exercising lawful rights available through their payment provider or financial institution.

46. Exchanges

Where operationally available, we may offer an exchange instead of a refund.

The availability of exchanges may depend on:

  • Product availability

  • Product type

  • Customer location

  • Reason for return

Customers are not required to accept an exchange where applicable law entitles them to another remedy.

47. Replacement Products

If a replacement is agreed, shipment timing will depend on:

  • Product availability

  • Delivery destination

  • Processing requirements

  • Courier availability

We will provide relevant information regarding the replacement where appropriate.

48. Contact Before Returning

To avoid delays or sending goods to an incorrect location, please contact us before dispatching a return:

info@bricolonex.com

We will provide the relevant return instructions.

The return location may differ from our registered office depending on logistics arrangements.

Therefore, products should not automatically be sent to the Company’s registered office unless our return instructions specifically indicate that address.

49. Proof of Return

We recommend using a shipping method that provides evidence of dispatch.

Customers should retain:

  • Shipping receipt

  • Tracking number

  • Proof of postage

until the return and refund have been completed.

This is particularly useful where proof of dispatch is required before returned goods have reached us.

50. Personal Data and Returns

Information provided during a return or refund request may be processed for purposes including:

  • Identifying the customer

  • Identifying the order

  • Processing the return

  • Issuing the refund

  • Preventing fraud

  • Maintaining accounting records

  • Meeting legal obligations

Further information is available in our Privacy Policy.

51. Relationship With the Terms and Conditions

This Refund Policy forms part of the contractual information applicable to purchases through bricolonex.com.

It should be read together with our Terms and Conditions.

If any provision of this Refund Policy conflicts with mandatory Consumer law, the mandatory legal provision will prevail.

52. Changes to This Refund Policy

We may update this Refund Policy to reflect changes in:

  • Our products

  • Return procedures

  • Logistics arrangements

  • Payment systems

  • Applicable legislation

  • Consumer protection requirements

  • Business operations

The version applicable to a particular purchase will be interpreted in accordance with the contractual and mandatory legal rules applicable to that purchase.

The latest version will be published on this page.
